Terms & Conditions for Online Course - “The Feature Wall Bootcamp”

Before you purchase, please read the following terms and conditions carefully. By purchasing this course, you agree and accept these terms and conditions.

1. Course Access and License:

1.1. The online course on The Feature Wall Bootcamp ("the Course") is provided by Maison Coutts ("the Course Owner"), a trade name of Fitshion Media Corp.

1.2. The Course Owner grants you a non-exclusive, non-transferable license to access and use the Course for personal and educational purposes only.

1.3. The information, materials, text, graphics, images, logos, videos, site design in the Course, and the selection, assembly, and arrangement of the Course (collectively “Content”) is proprietary in nature and protected by all applicable Canadian and international copyright and trade-mark laws. The Content cannot be altered without infringing on Course Owner’s rights, including without limitation its moral rights. All course materials, including but not limited to videos, documents, quizzes and all downloadable files, are the intellectual property of the Course Owner. No aspect or part of this Course can be reproduced, copied, distributed, or transmitted in any way, shape, or form or by any means whatsoever without the express prior written authorization by the Course Owner.

1.4. All sales of the Course are final, and you will not be entitled to a refund for the purchase of the Course.

1.5. The Course Owner makes a reasonable effort to make the Course available on most computers and other electronic devices, but offers no guarantee that it will work on your computer and/or electronic devices. It is your responsibility to ensure that your devices meet the technical standards of the Course. Unless otherwise noted, the Course is internet-based and in order to access the Course you must have: an internet browser and access to the internet.

1.6. Because of the nature of internet and online communications, the Course may not perform as intended despite our efforts, those of your internet service provider, and yourself. We do not guarantee uninterrupted or error free operation of the Course. We will use reasonable efforts to maintain operation of the Course and availability of the Course at all times. If there is a system error or other problem concerning the Course, you agree to promptly notify us of the same, we will try to correct the error, but you will not be entitled to any money or refund as the result of any error.

2. Appearance, Equipment and Safety Disclaimer:

2.1. The Course is designed to provide educational content on building your own feature wall. The Course does not guarantee results or guarantee that your feature wall will match those feature wall(s) displayed or shown in the Course. The outcome of your feature wall is dependent on your own skill and materials.

2.2. The instructions provided in the Course are not safety instructions. It is your responsibility to assess your own surroundings when building a feature wall and follow all reasonable security and safety measures. This includes but is not limited to wearing safety equipment such as a hard hat, safety goggles, etc, and the responsible and safe use tools and equipment. Occasionally, individuals in the Course may forgo the wearing of safety equipment and/or use items in manner not consistent with a manufacturer’s recommendations in order to enable filming. This is not an endorsement or recommendation to you to forgo any such safety equipment or the safe use of any tools or equipment. You are also strongly advised to follow all safety guidelines and instructions provided by your tool and equipment manufacturer(s).

2.3. The Course Owner is not responsible for any bodily harm, injuries, or damages that may occur as a result of you taking the Course, following instructions or methods used in the Course, and/or using power tools, saws, or any other equipment or tools discussed or displayed in the Course.

2.4. The use of any particular tool(s) or equipment in the Course is not an endorsement of any tool(s) or equipment. The Course Provider does not guarantee that said tool(s) or equipment will be appropriate for your own use.

3. Assumption of Risk:

3.1. By enrolling in the Course, you acknowledge, understand and agree that the use of power tools, saws and other tools or equipment involves inherent risks. You voluntarily assume all risks associated with using such tools, and you agree to take all necessary precautions to ensure your safety.

4. Limitation of Liability:

4.1. To the maximum extent permitted by law, the Course Owner shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with your use of the Course.

4.2. Course Owner or its affiliates will not be liable to you or any other party for any direct, indirect, special or other consequential damages while building a feature wall, for any use of or reliance upon the information found in the Course, including, without limitation, personal injury, third party injury, death, lost profits, business interruption, or any other damages even if Course Owner is expressly advised of the possibility of such damages.

4.3. If you or anyone viewing the Course as a result of your purchase is injured, hurt, maimed or killed building a feature wall, the Course Owner is not responsible for said injury, pain, or death.

4.4. Course Owner shall be not liable for any direct, special, incidental, indirect or consequential damages, including for any injuries, lost profits or lost income, that result from your use of, or the inability to use the Course.

4.5. If the Course Owner is found to be liable to you for any damage or loss which is in any way connected with your use of the Course, the Course Owner’s liability shall not exceed the purchase of price of the Course.

4.6. All content found or accessed through the Course is provided on an "AS IS" basis and without warranties of any kind, either expressed or implied.

5. Release and Indemnification

5.1. By purchasing this Couse, you hereby release and forever discharge the Course Owner, and all of their successors, administrators, assigns, affiliates and related companies, and their directors, officers and employees of and from all actions, causes of action, damages, claims, cross claims and demands whatsoever, (including all damages, loss and injury not now known or anticipated but which may arise in the future and all effects and consequences thereof), however and wherever arising from your participation in the Course, following the Course, building a feature wall, or attempting any actions described or taught in the course. This includes but is not limited to any personal injury (including death), lost income or property damage.

5.2. By purchasing this course, you agree to hold harmless and fully indemnify Course Owner for any claims, lawsuits, actions, causes of actions or demands against Course Owner brought by you or any third party arising out of your purchase and use of the Course, or any third party who views or follows the Course through your purchase.

6. Eligibility:

6.1. You must be at least 18 years old or have the consent of a legal guardian to enroll in the Course.

7. Third-Party Products:

7.1. The Course may recommend or discuss third-party products for use in association with the Course. The Course Owner is not responsible for the performance, quality, or safety of any third-party products, and any use of such products is at your own risk.

7.2. The Course Owner is not responsible for any changes in third-party product pricing or availability. It is your responsibility to verify and comply with the terms and conditions of third-party products.

7.3. You acknowledge and understand that the Course Owner may receive income or other consideration from the third-party links shared in the Course. As much as required, you consent to said third-party payments to the Course Owner.

8. Modifications:

8.1. The Course Owner reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on the Course website.

9. Termination:

9.1. The Course Owner reserves the right to terminate your access to the Course at any time for violations of these terms and conditions, or for any other reason, without refund or recourse.

9.2. The Course Owner reserves the right to remove or delete the Course upon thirty (30) days notice to you. Notification will be given to the email address on file with your account. It is your responsibility to keep said email address active and up to date.

10. Personal Information

10.1. In order to provide the Course to you, you must provide us with certain personal information about yourself. You consent, authorize and instruct us to collect, use, monitor, compile and disclose your personally identifiable information. By placing your order, you acknowledge and agree that your access to the Course and any personally identifiable information contained therein is subject to your prior written authorization and our approval of your order. By submitting your order, you agree that we may collect and use your personal information.

11. Disclaimer

11.1. OTHER THAN THOSE STATED IN THIS AGREEMENT, COURSE OWNER DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE

12. General Provisions:

12.1. Access to, and use of, the Course is subject to all laws and regulations applicable in the Province of Ontario. These Terms and Conditions will be interpreted under Ontario law, and in the event of any dispute, you submit to the exclusive jurisdiction of Ontario courts located in Toronto. Notwithstanding Ontario laws and regulations, individuals residing in or accessing the Course in an area where the access to or use of the Course or any part of is illegal or prohibited are not permitted to use the Course. It is your responsibility to determine if you can legally use the Course in compliance with all applicable laws.

12.2. If any term or condition in these terms and conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severable from the rest of the terms and conditions and shall not affect the validity and enforceability of any remaining provisions of the terms and conditions There may be terms, exclusions and conditions of the written contracts relating to products mentioned on this the Course Owner’s website are not fully described in these terms and conditions. Their interpretation is governed by the terms and conditions of the contract you enter with us, and by any applicable laws and regulations.

12.3. All words importing the masculine gender only shall include the feminine gender and the neuter (as appropriate) and vice versa. All words importing the singular shall include the plural and vice versa.

12.4. These terms and conditions shall endure to the benefit of and be binding upon the parties and their respective heirs, executors, administrators, successors and assigns, as the case may be.

13. Acknowledgement

13.1. You acknowledge and agree that you have had sufficient opportunity to fully consider the contents of these terms and conditions and that you have read, understand, and agree with these terms and conditions.

13.2. You further understand and acknowledge that these terms and conditions will be entered into electronically, and you consent and agree that any and all information about this terms and conditions, our relationship with you, our policies, and any further notices or communications may be provided to you by electronic means.
